Applications are filed with the Office of the Controller General of Patents, Designs and Trade Marks.


4. How long does it take to obtain a patent in India?

The patent process usually takes 2 to 5 years, depending on examination timelines and responses to objections.


5. What is the validity of a patent?

A patent is valid for 20 years from the date of filing, subject to payment of annual renewal fees.


6. What is a provisional patent application?

A provisional patent application allows an inventor to secure an early filing date while the invention is still under development. The complete specification must generally be filed within 12 months.


7. What cannot be patented in India?

Certain inventions are not patentable, such as:
