Design Registration in India
1. What is Design Registration?
Design Registration is a form of intellectual property protection granted under the Designs Act, 2000. It protects the visual appearance of a product, including its shape, configuration, pattern, ornamentation, or composition of lines or colors applied to an article.
The protection is only for the aesthetic features of a product and not for its functional or technical aspects.
2. Objective of Design Registration
Design registration aims to:
Protect the original visual appearance of products.
Prevent unauthorized copying or imitation by competitors.
Encourage innovation and creativity in product design.
Provide the owner exclusive rights over the registered design.

4. Legal Authority
Designs in India are registered with the
Office of the Controller General of Patents, Designs & Trade Marks under the
Indian Patent Office.

5. Requirements for Design Registration
To qualify for registration, a design must:
Be new or original
Not be previously published anywhere in the world
Be visually appealing
Be capable of being applied to an article by an industrial process
Not contain scandalous or obscene matter

Representation of design (drawings or photographs)
Description of the article
Class of article under Locarno Classification
Power of Attorney (if filed through an agent)
7. Design Registration Process in India
Step 1: Design Search
Conduct a search to check whether a similar design already exists.
Step 2: Filing Application
Submit Form-1 along with drawings or photographs of the design.
Step 3: Examination
The design office examines the application for originality and compliance.
Step 4: Objection (if any)
If objections are raised, the applicant must respond within the prescribed time.
Step 5: Registration & Publication
Once accepted, the design is registered and published in the Design Journal.
8. Validity of Design Registration
Initial protection: 10 years
Can be extended for an additional 5 years
Total protection period: 15 years
9. Rights of the Design Owner
After registration, the owner has the exclusive right to:
Apply the design to the article
Manufacture the product with the registered design
Sell or license the design
Take legal action against infringement
10. Infringement of Registered Design
If someone copies or uses a registered design without permission, it amounts to design piracy.
The owner can file a legal suit for damages and injunction.
