DRT Practice
Recovery and defence in India’s specialised debt forum.
The Debt Recovery Tribunal exists to give lenders a faster route to recovery than ordinary civil courts — but that speed only helps a client whose case is presented correctly. MovLegal represents banks, financial institutions, and borrowers in debt recovery proceedings before the DRT and Debt Recovery Appellate Tribunal (DRAT), acting for both sides of the lending relationship.
Why This Matters
DRT proceedings sit at the intersection of contract, security, and procedure — a lender’s recovery claim can be delayed or defeated by a borrower’s procedural challenge, just as a borrower’s defence can fail without properly raised objections. We bring the same rigour to both sides of this practice.
Our DRT Practice Services
Original Applications (OAs)
Filing and defending recovery applications before the DRT under the Recovery of Debts and Bankruptcy Act (RDDBFI Act).
SARFAESI Proceedings
Advising lenders on enforcement of security interest under the SARFAESI Act, and representing borrowers challenging SARFAESI action they believe is improper.
Securitisation Applications
Filing Section 17 SARFAESI applications before the DRT challenging possession or sale notices issued by lenders.
DRAT Appeals
Representing clients in appeals against DRT orders before the Debt Recovery Appellate Tribunal.
