DESIGN APPLICATION FILLING

1. What is Design Application Filing?

A design application is filed to obtain legal protection for the visual appearance of an article, including its shape, configuration, pattern, ornamentation, or composition of lines or colors. Design protection in India is governed by the Designs Act, 2000 and the Designs Rules, 2001.

The application is examined and registered by the Office of the Controller General of Patents, Designs and Trade Marks.


2. What Can Be Registered as a Design?

A design can be registered if it:

  • Is new or original

  • Has not been published previously anywhere in the world

  • Relates to the aesthetic appearance of a product

  • Is capable of being applied to an article by an industrial process

3. Documents Required for Design Filing

The following documents are typically required:

  • Form-1 (Application for registration of design)

  • Representation of the design (drawings or photographs)

  • Description of the article

  • Class of the article (Locarno Classification)

  • Applicant details and address

  • Power of Attorney (if filed through an agent)


4. Design Application Filing Process

The process generally includes the following steps:

Step 1: Design Search
Conduct a search to ensure that the design is new and not previously registered.

Step 2: Preparation of Application
Prepare drawings or photographs of the design and complete the application form.

Step 3: Filing the Application
File the application with the Design Office along with prescribed fees.

Step 4: Examination
The design office examines the application for novelty and compliance with legal requirements.

Step 5: Registration and Publication
If accepted, the design is registered and published in the Design Journal.


5. Validity of Design Registration

  • Initial protection: 10 years

  • Extension: Additional 5 years

Total protection period: 15 years.
